Subscription Services

Win Amazing offers a subscription service that allows customers to receive bundles of tickets on a monthly basis. All tickets purchased through a subscription will be entered into all of our prize competitions ongoing as at the date of purchase of the tickets. By subscribing to our subscription service, you will automatically and immediately receive your initial set of tickets by email, and your ongoing subscription tickets by email on the first of every month. You will be able to view all tickets in your online account. The specific terms and conditions for each competition will be listed on our website.

 Win Amazing Subscription Terms and Conditions

 1.    Introduction

Win Amazing subscription terms and conditions govern your use of the Win Amazing subscription service as described in paragraph 3. The website terms and conditions at https://winamazing.co.uk should be read in conjunction with these subscription terms and conditions.  By subscribing to our subscription service, you agree to be bound by these subscription terms and conditions. If you do not agree to these terms and conditions, you should not use our subscription service.

If there is any inconsistency or conflict between these subscription terms and conditions and the website terms and conditions, it shall be resolved in accordance with the following order of precedence:

2.    Subscription Services and Plans 

    a. Subscription Services 

     The Subscription Services are offered only for your personal, non-commercial use,    and not for the use or benefit of any third-party. We may, in our sole discretion, refuse to offer some of or all of the Subscription Service to any person who is receiving, or any potential subscriber.  

b.    Subscription Plans

Win Amazing offers varying subscription costs and plans. The subscription plan you select will determine the number of tickets you  receive and the cost of your subscription. Win Amazing offers a £10/month subscription package, which awards 45 tickets per month and a £25/month subscription package, which awards 150 tickets per month All tickets purchased through a subscription will be entered into every competition live as at the date of purchase, as set out in paragraph 3. No subscription is necessary to enter our prize competitions. A free entry option is always available; please see details at https://winamazing.co.uk/post. If you choose to use our subscription service you can cancel your subscription and submit a free entry at any time. 

3. Account registration 

To enjoy full access and use of our Subscription Services, you may be asked to provide certain registration details or other information to create a user account.

• Account Information: Conditions of your use of the Subscription Services, to ensure all the information you provide is correct, current, and complete. You must not use someone else’s name, or any name, location, other public profile information or image that violates any third-party rights. You agree to promptly notify us if any of your information changes or is inaccurate.

• Account Security: Your Account is for your personal use only. Do not allow others to use your Account and transfer your Account to any other person or entity. You must safeguard the confidentiality of your password, and if you are using a device that others have access to, you need to log out of your Account after using the Subscription Services. You are responsible for all activity that occurs under your Account, including any activity by unauthorized users, unless you can demonstrate that any unauthorized use was not due to your fault or negligence. If you suspect or know of unauthorized access to your Account, change your password and immediately notify Win Amazing by sending an email to hello@winamazing.co.uk.

4.    Payment and Billing

At the time of subscription you will be charged an initial subscription fee for your chosen subscription plan. Subscription fees for subsequent months will be charged to the payment method saved to your account on a recurring basis on the 1st of every month. Your subscription will be cancelled if we are unable to complete your renewal using the payment method saved to your account. The details of your billing and payment history can be viewed on our website.

We may increase the price of our subscription plans from time to time. Should we increase the price of our subscription plans, the changes to the subscription fees will be displayed on our Website and notified to you by email at least seven days before the change comes into effect. Please see paragraph 6 for details of how to cancel or pause your subscription. You will not be charged the increased price if you cancel or pause your subscription before the change comes into effect. 5.    Automatic Renewal
Unless you cancel or pause your subscription prior to the Renewal Date.

Your subscription will automatically renew with no action required from you first 

day of each month (Renewal Date) during your subscription 

6.    Cancelling or Pausing

 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the Regulations) you have the right to cancel your subscription for any reason within 14 days of the date of your subscription starting (the Cooling Off Period). Please note that this right to cancel will not apply to any monthly renewals of your subscription.

Cancelling your subscription will not affect the validity of any tickets already entered into draws.

If you wish to exercise your right to cancel under the Regulations, this contract will come to an end and Win Amazing will reimburse you payments received from you for your subscription. This reimbursement will be completed no later than 14 days after the day on which we received confirmation of your decision to cancel your subscription. Win Amazing will compete the reimbursement by using the same means of payment you used to pay for your subscription, unless you specifically agree otherwise. 

You specifically agree and acknowledge that:

i.    Win Amazing may give you access to your subscription during the Cooling Off Period; and

ii.   if you exercise the right to cancel under the Regulations:

a.  you will receive a full refund, (prior to any draws taking place), for tickets purchased using your subscription. Tickets purchased will be removed from any draws into which they have yet been entered.  

 

7.    Age requirement:

To use our subscription service, you must be at least 18 years of age and a legal resident of the United Kingdom where our services are legally available. You must also have legal capacity to enter into a contract with us and can’t be in breach of any agreements with us or any of our terms and conditions (including these ones). You are responsible for ensuring that your use of our subscription service complies with all applicable laws and regulations.

8.    User Conduct

While using our subscription service you are solely responsible for your conduct and must not violate these subscription terms and conditions. We have the right to, suspend, delete, disable and terminate your subscription and access to the Subscription services if we determine you have used our services for any unlawful or fraudulent purpose, or in a manner that infringes upon the rights of others. If we believe you have.

9.    Intellectual Property

Win Amazing own all intellectual property rights associated with our website and the content, and our subscription service. You are not permitted to use any of our intellectual property without our prior written consent.

10.Liability

To the extent permitted by law, Win Amazing will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of our subscription service, including any loss of data, profits, revenue, or business interruption. Nothing in this paragraph 9 shall exclude or limit any liability that cannot be excluded or limited at law.

Win Amazing Have no obligation or liability resulting from:

1. Incorrect or incomplete information provided by you, or technical errors, by any equipment or programming associated by Win Amazing.
2. Technical failures of any kind including malfunctions, interruptions, disconnecting of phone lines or network hardware, unscheduled maintenance or software. 
3. The inability to use subscriptions services
4. Unauthorised access to your transmissions or data
5. Third party conduct or statements on our website
6. Any other matter relating to subscription services 
7. The cost of obtaining substitute goods, services, technology, and any indirect, incidental consequential or special damages arising in connection with access to the use of the subscription services. Even if Win Amazing and/or its affiliates have been advised of the likelihood of such damages. Win Amazing to the full extent allowed under the applicable law accumulate liability to you or any third part in any circumstance shall not exceed one hundred and ten pounds (£110.00) 

You acknowledge and agree that your sole remedy for breach of any of these subscription terms, problems or dissatisfaction with the subscription’s services, the website and any portion of the software will terminate your account to stop the use of the subscription services, the website and software.

11. Termination

We may terminate your subscription at any time for any reason without prior notice.

12. Governing Law

These subscription terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these terms and conditions shall be resolved exclusively by the courts of England and Wales.

13. Changes to Subscription Terms and Conditions

We reserve the right to change these subscription terms and conditions at any time without prior notice by posting the revised terms on our website. You are responsible for reviewing these terms and conditions periodically to ensure that you are aware of any changes. Your continued use of our subscription service following any changes to these terms and conditions constitutes your acceptance of the revised terms. If you do not agree to any changes, you must cancel your subscription. Please see paragraph 6 for details of how to do this.

14. Release and Waiver

By subscribing to our subscription service, you agree to release and waive any and all claims, demands, and causes of action arising out of or in connection with your use of our subscription service.

15. Indemnification

You agree to indemnify, defend, and hold harmless Win Amazing, its affiliates, officers, directors, employees, agents, and third-party service providers from and against any and all claims, demands, liabilities, damages, losses, expenses, and costs, including reasonable attorneys' fees, arising out of or in connection with your use of our subscription service, your violation of these subscription terms and conditions, your violation of any applicable laws or regulations, or your violation of any rights of another person or entity.

17. Entire Agreement

These subscription terms and conditions and the Website terms and conditions, together with any additional terms and conditions that may be applicable to specific prize draws, constitute the entire agreement between you and Win Amazing regarding your use of our subscription service.

18. Assignment

Win Amazing may assign these subscription Terms, in whole or in part, to any person or entity ate any time with or without your consent.

You may not assign or transfer these subscription terms and conditions, or any of your rights or obligations hereunder, without our prior written consent. Any attempted assignment or transfer in violation of this provision will be null and void.

19. Waiver

The failure of Win Amazing to enforce any right or provision of these subscription terms and conditions will not be deemed a waiver of such right or provision.

20. Severability

Our failure to enforce any provision of these Subscription Terms shall no way be taken to be a present of future waiver of such provision. The provision of these subscription terms and conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these subscription terms and conditions will otherwise remain in full force and effect.

21. Interpretation

These subscription terms and conditions will be interpreted in accordance with their plain meaning and not strictly for or against either party.
